These Terms of Service ("Terms") govern your access to and use of Wild West Offroad Trails (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility and Use
You represent that you are legally able to agree to these Terms and are responsible for your use of the Site and any content you submit.
User Submissions and License
You retain ownership of the files and content you submit. By uploading content (including files, waypoint data, comments, descriptions, and images), you grant Wild West Offroad Trails a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify for formatting or display, publish, distribute, and make that content available through the Site and related services.
This license includes the right to use third-party service providers, hosting platforms, storage systems, CDNs, and similar infrastructure as reasonably necessary to operate, secure, back up, and deliver the Site. Limited archival, backup, or system copies may remain for a reasonable period after content is removed from public display.
Upload Responsibility (Files, Images, and Metadata)
You are solely responsible for reviewing files before upload. Files and images may contain personal or sensitive information such as precise locations, timestamps, waypoint names, notes, descriptions, route history, EXIF metadata, and device details.
You agree to upload only content you have the right to share and that is allowed to be made public. Do not upload private, sensitive, or unauthorized third-party information.
Moderation and Content Removal
We may review, reject, unpublish, restrict, or remove content at any time for safety, quality, policy, legal, operational, or other legitimate reasons. We may also suspend access for users who misuse the Site.
Prohibited Conduct
- Uploading illegal, infringing, abusive, threatening, or harassing content.
- Uploading content containing private or unauthorized personal information of others.
- Attempting to disrupt, abuse, scrape, probe, or interfere with Site operations or security.
- Impersonation, fraud, spam, malware distribution, or other deceptive activity.
Copyright and Takedown Requests
If you believe content on the Site infringes your rights, contact us with sufficient detail to identify the material and your claim at info@wildwestoffroadtrails.com. We may remove or restrict access to challenged material while reviewing a claim.
Privacy
Your use of the Site is also governed by our Privacy Policy. Please review it to understand how we handle data, including upload-related metadata and deletion requests.
No Warranty
The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Trail conditions, map data, water data, and related information may be incomplete, inaccurate, or outdated and should not be treated as guaranteed safe or current.
Assumption of Risk
Off-road travel, route finding, remote access, water crossings, weather exposure, changing land conditions, and vehicle recovery all involve inherent risk. By using the Site, you acknowledge and accept full responsibility for your own trip planning, navigation choices, land-use compliance, vehicle preparation, safety decisions, and travel outcomes.
Wild West Offroad Trails is not responsible for injuries, vehicle damage, property damage, towing or recovery costs, closures, trespass issues, changing trail conditions, or other losses arising from use of the Site or reliance on community-submitted information.
Limitation of Liability
To the maximum extent permitted by law, Wild West Offroad Trails and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or use arising from or related to your use of the Site or user-submitted content.
Indemnification
You agree to defend, indemnify, and hold harmless Wild West Offroad Trails and its operators from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your submissions, your use of the Site, or your violation of these Terms or applicable law.
Termination
We may suspend or terminate access to the Site, or remove content, at any time if we believe these Terms or applicable laws have been violated, or to protect the Site and community.
Changes to These Terms
We may update these Terms from time to time. Updated Terms are effective when posted on this page. Continued use of the Site after updates constitutes acceptance of the revised Terms.
Reservation of Rights
Except for user-submitted content owned by its respective submitters, all Site software, design, branding, text, graphics, compiled data, and other Site content are owned by Wild West Offroad Trails or used with permission. No rights are granted except as expressly described in these Terms.
Governing Law
These Terms are governed by applicable laws in the United States and the State of Nevada, without regard to conflict of law principles.
